Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Next Build LLC website (the “Site”), operated by Next Build LLC, a Florida limited liability company (“Next Build,” “we,” “us,” or “our”).

By accessing or using the Site, you confirm that you are at least 18 years of age and agree to be bound by these Terms.

Next Build is a licensed Florida building contractor serving Florida’s Gulf Coast under License No. CBC1263895. The Site provides information about our residential custom builds, build-to-rent investor solutions, commercial construction, B2B construction partnerships, project management, team, design approach, and related construction services.

Any information provided on the Site is for general informational and marketing purposes only. A binding agreement between you and Next Build is created only when both parties sign a separate written agreement.

1. Services and Use of the Site

The Site may provide information about:

  • Residential custom home construction;

  • Design-to-build services;

  • Build-to-rent and investor-focused construction solutions;

  • Commercial construction services;

  • B2B construction partnerships;

  • Project management, permitting support, and construction coordination;

  • Design references, renderings, project concepts, and portfolio-style images;

  • Contact forms, consultation requests, and general inquiry submissions;

  • Educational or informational content related to building, investing, and construction along Florida’s Gulf Coast.

Any pricing, budgets, schedules, square-foot ranges, timelines, renderings, design concepts, or construction expectations published on the Site are estimates or examples only. They are subject to change and do not constitute a binding offer, quote, contract, or guarantee.

A formal scope of work, pricing, timeline, payment structure, and project obligations will only be established through a written agreement signed by the appropriate parties.

2. Acceptable Use and Restrictions

Personal and Informational Use:
The content on the Site is provided for personal, non-commercial, informational use only.

No Automated Access:
You may not use bots, scrapers, crawlers, data-mining tools, or other automated methods to extract, copy, harvest, or reproduce content, images, renderings, layouts, designs, or project information from the Site, except for standard search-engine indexing.

Intellectual Property:
All content on the Site, including text, graphics, photographs, renderings, layouts, icons, branding, service descriptions, design concepts, and the Next Build name, is owned by Next Build LLC or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You may not copy, reproduce, distribute, modify, display, publish, sell, reverse engineer, or use any Site content for commercial purposes without prior written permission from Next Build.

Accuracy of Information You Provide:
You agree to provide accurate, current, and complete information when submitting forms, requesting consultations, or contacting us.

No Unlawful Use:
You may not use the Site for any unlawful purpose, to harass or harm others, to upload malicious code, to interfere with the Site’s functionality or security, or to attempt unauthorized access to any systems connected to the Site.

3. Renderings, Images, and Design Disclaimer

Renderings, images, graphics, photographs, and design concepts shown on the Site are for illustrative, inspirational, or marketing purposes only.

Features shown in renderings, images, or design examples may not be available, may differ from final construction, or may be available only at additional cost. Final selections, finishes, materials, layouts, site conditions, code requirements, engineering requirements, and permitting approvals may affect the final project.

4. No Professional Advice; Estimates Disclaimer

Information on the Site, including construction descriptions, investment-related language, permitting commentary, timelines, pricing references, design ideas, and project examples, is provided for general informational purposes only.

The Site does not provide legal, financial, tax, engineering, architectural, real estate investment, or professional construction advice.

Project-specific decisions, including scope of work, pricing, structural requirements, engineering, permitting strategy, design specifications, zoning considerations, and investment feasibility, can only be confirmed through appropriate professional review, consultation, written proposals, and executed agreements.

You should consult qualified professionals where appropriate before making legal, financial, real estate, construction, or investment decisions.

5. Inquiries, Forms, and Lead Submissions

Submitting a form on the Site, requesting information, or contacting Next Build does not create a contractor-client relationship, partnership, fiduciary relationship, or binding agreement.

A formal relationship is established only through a separate written agreement signed by the appropriate parties.

Information you submit through the Site is handled in accordance with our Privacy Policy.

6. Third-Party Links and Services

The Site may contain links to, embeds from, or integrations with third-party platforms or services, including but not limited to website hosting tools, scheduling tools, maps, social media platforms, analytics services, CRM systems, payment providers, or other digital tools.

Next Build is not responsible for the content, terms, privacy practices, security, or availability of third-party websites or services. Your use of third-party services is governed by their own terms and policies.

7. Site Disclaimer and Limitation of Liability

The Site is provided on an “as is” and “as available” basis.

To the fullest extent permitted by Florida law, Next Build disclaims all warranties, express or implied, regarding the Site, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, and non-infringement.

Next Build does not guarantee that the Site will be uninterrupted, error-free, secure, or free of viruses or harmful components.

To the fullest extent permitted by law, Next Build will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of, or inability to use, the Site.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under Florida law. Nothing in these Terms modifies or limits any warranties, obligations, or rights contained in a separately executed written construction agreement between you and Next Build.

8. Construction Agreements Control

Any construction, design-build, commercial, investor, B2B, project management, or consulting services provided by Next Build will be governed by the separate written agreement applicable to that project or service.

If there is any conflict between these Terms and a signed written agreement between you and Next Build, the signed written agreement will control for that specific project or service.

9. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or your use of the Site shall be brought in the state or federal courts located in [Insert County], Florida, unless otherwise required by law or agreed to in a separate written agreement.

You consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” at the top of this page indicates when the Terms were last revised.

Any material changes will be posted on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
